PSAA Terms & Conditions

OBJECTIVE

  • In our fight against the rise of scammers, PSAA's objective is to identify "legitimate" registered and non-registered breeders and pet transport companies in order to provide a safe platform for potential buyers of pets. PSAA makes no representations as to the quality of a breeder, a service provider, the quality of a service provided, or to the health and suitability of a pet being exchanged. PSAA makes no representations as to the quality of service you may contract from anyone registered with us. It is the buyer's responsibility to ensure all quality checks have been satisfied prior to contracting any service registered with PSAA.

SUBSCRIPTION FEES

  • Subscription Fee is payable on application and non-refundable. Membership fees are payable quarterly, biannually or annually, due prior to expiry of current membership.

MISREPRESENTATION

  • Any misleading or fraudulent representation of personal details, the total number of dogs included in your application or any other relevant information may result in the subscription being cancelled immediately without a refund and may result in being placed on PSAA Scammers List.

PSAA CODE OF ETHICS

This means a PSAA member agrees to conform to the high ethical standards with regard to all the activities as an animal owner and breeder. By becoming a member of the PSAA you accept the values and standards of PSAA and MUST abide by ALL the Rules and ALL Codes of Ethics stated below:

  • Uphold and adhere to ALL relevant local, state/territory and national legislations and Animal Welfare Acts which are applicable to them, their premise and location.

  • Act with honesty and integrity in ALL dealings with other people when keeping, maintaining, selling animals.

  • Provide clean and spacious living conditions for all breeding and companion animals. Always provide a healthy and safe environment for any animal in care.

  • Cats and dogs must not be housed in cages. Cages may only be employed for transport, safety during recovery from disease, injury or illness treatment/quarantine, and closely monitored crate training (only if advised or approved by a vet).

  • Animals must spend the majority of their lives in communal runs and have access to natural lighting/ventilation and nature.

  • Animals must be fed a complete, premium diet appropriate for their age/weight as outlined in our feeding guide.

  • Never breed an underage animal. Please refer to recommendations backed by Companion Animals legislation. 

  • Never breed a female dog more than 4 times in their lifetime and must retire a breeding dog after 8 years of age. Bill of health from Vet must be obtained after 4 litters. 

  • Never breed animals of the same bloodline. 

  • Never breed animals carrying hereditary diseases - PSAA Require breeders to obtain DNA and Genetic screening for all breeding animals,

  • A probationary period of 6mth will be applied, if a breeder does  not have DNA and GENETIC screening for breeding animals. Proof of testing will be requested. 

  • Never breed from animals displaying any defects or illnesses.

  • ALL health concerns found or known must be disclosed to the prospective buyer.

  • Keep health records for all companion pets in care.

  • Keep and maintain all breeding records for all registered breeding animals.

  • ALL animals in care must have routine health checks and must be up to date with immunisations and/or titre testing. This applies to breeding parents, and the litters available for sale.

  • Members must seek veterinary care immediately for any animals/pets showing signs/symptoms of a disease and must consult with their primary veterinarian throughout the breeding process.

  • In the event that euthanasia is both necessary and humane, where all other options have been exhausted, the procedure must be performed by a qualified veterinarian, a detailed vet report and explanation must be provided to PSAA.

  • All animals being sold by must be microchipped, have had first vaccination done, wormed, flea treated and vet checked.

  • All animal sale advertisements MUST contain PSAA breeder/member numbers.

  • Members must take all measures to ensure prospective owners and their environment are suited to caring for the animal and be satisfied that the animal's welfare will not be compromised.

  • Never release a puppy or kitten to the new owner prior to eight weeks of age. 

  • Any animal being sent via freight must be of ten weeks of age or older.

  • Provide new animal owners ALL essential documentation, Sale Contracts, comprehensive general information on a fact sheet and provide postsale support required for their new pet.

  • A postsale agreement outlining all health tests completed by a veterinarian must be provided at the time of sale, including information on other unpreventable and/or untestable conditions, and for which conditions refunds will be offered.

  • Expenses for the treatment of preventable genetic and/or health problems present from birth which arise within the first 12 months of the animal’s life are the sole responsibility of the PSAA member, up to the price of the animal. This includes costs and veterinary care associated with any diseases or injuries present during the time of sale. Members must cover these costs up to the price of the animal (no more than the cost of the animal is claimable), or receive the animal back with a refund of the original cost of the animal (as well as taking responsibility for responsibly/ethically rehoming the animal), or replace the animal with a healthy one.

  • Members are solely responsible for rehoming any owned animals in their care or that have been bred during the animal’s lifetime. Should an animal be rendered homeless, the PSAA will be happy to assist and provide advice where possible.

  • PSAA member numbers may not be used for any other purpose or animal that is not approved by PSAA.

  • All members agree to be subject to internal and external investigations as a result of a complaint.

  • All registered members consent to random site & compliance audits and inspection without notice.

DISCLAIMERS & RESERVATIONS

  • PSAA reserves the right to refuse registration to anyone.

  • PSAA reserves the right to amend the Code of Ethics and Terms & Conditions at any time.

  • PSAA will make every attempt to keep all unethical breeders out of the PSAA Breeder Directory. If you suspect member on the Breeder Directory being in violation of legal and ethical standards, please report it to PSAA.

  • PSAA website may be changed or made partly or wholly unavailable at any time without any liability from the cessation of the Website.

  • If PSAA suffers loss or damage or incur any costs associated with any breach of Terms & Conditions or Codes of Ethics by you (a registered member or any associated legal obligation), you agree to indemnify us for those losses, damages, and costs.

  • Information published on this Website is true and correct at the time of its publishing. PSAA is not responsible for any changes which have been made post publishing date.

  • PSAA provides a verified legitimate breeders listing/directory and is not liable or responsible for post introductory services, transactional disputes, agreements or arrangements between parties.

  • PSAA is an introductory medium ONLY for buyers and real sellers of companion animals. Post introduction discussions or transactions are not the responsibility of PSAA.

LIMITATION OF LIABILITY

  • PSAA is an introductory medium ONLY for buyers and real sellers of companion animals. Post introduction discussions, agreements or transactions are not the responsibility of PSAA.

  • PSAA provides a verified legitimate breeders listing/directory and is not liable or responsible for post introductory services, agreements, arrangements, transactions or transactional disputes, between parties.

  • By using this Website, you agree to absolve PSAA of any liability or loss that you or any other person may incur from use of the information, products or materials that you request or receive through or on the PSAA. You agree that PSAA will not be liable to you, or to any other individual, company or entity, for any type of damages, including direct, indirect, special, incidental, equitable or consequential loss or damages, for use of or reliance on our Website. You agree that we do not assume liability for accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease or condition or issue, or any other type of loss or damage due to any act or default by us or anyone acting as our agent, consultant, affiliate, joint venture partner, employee, shareholder, director, staff, team member, or anyone otherwise affiliated with the PSAA business, who is engaged in delivering content on or through this Website.

INDEMNIFICATION & RELEASE OF CLAIMS

  • This means, you hereby fully and completely hold harmless, indemnify and release PSAA and any of our agents, consultants, affiliates, joint venture partners, employees, shareholders, directors, staff, team members, or anyone otherwise affiliated with the business from any and all causes of action, allegations, suits, claims, damages, or demands whatsoever, in law or equity, that may arise in the past, present or future that is in any way related to this Website.

PSAA TERMS OF USE

  • This means a PSAA member agrees to conform to the high ethical standards with regard to all the activities as an animal owner and breeder. By becoming a member of the PSAA you accept the values and standards of PSAA and MUST abide by ALL the Rules and ALL Codes of Ethics stated in our registration process and agree to ALL Terms & Conditions outlined here. You agree and authorise PSAA to contact veterinary, Orivet and other related services to confirm your authenticity. If our criteria is not met, you understand your membership may and can be cancelled without a refund.

APPLICABLE LAW

  • The Terms & Conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of New South Wales, Australia and Courts of Appeal from them for determining any dispute concerning PSAA Terms & Conditions.
